
Handling TUPE
TUPE has earned the reputation as being one of the most complex areas of employment law. However it is built on some simple principles which, once understand help you to contextualise and understand employment transfers. This handling TUPE course is a must for anyone dealing with acquisitions or outsourcing.
Starting with the background to the Transfer of Undertakings (Protection of Employment) Regulations 2006 and briefly covering some of the recent changes to the TUPE legislation this course goes on to deal with the following modules:
- When does TUPE apply – outsourcing and insourcing, transfers through the sale of shares, sales of assets?
- Changing employment terms – what is the extent of protection afforded to employees? What, if any, changes can employers make to terms and conditions of employment both pre and post transfer.
- The duty to inform and consult – we explain the requirement, including an overview of the required timescales and the requirement to provide employer’s liability information.
- TUPE in practice – We outline some of the practical issues that we have had to advise on and offer our thoughts on how to deal with them.
