handling redundancy

Redundancy

No employer wants to make redundancies but if you need to make 3 or 300 employees redundant, we can help you. We provide redundancy advice to employers. We have extensive experience of advising on redundancies built up before the financial crash in 2008 as many of our employer clients were involved in mass redundancies due to ‘off shoring’ production from the turn of the century.

We advise employers on how to go through a redundancy process in as a reasonable and decent way as possible. From experience, we know that employees often know if a particular department or product line is in trouble and therefore redundancy does not come as a surprise to many employees. Employees want to be given adequate warning and consulted with fairly. By getting the process right you may be able to keep the goodwill of the employees you are making redundant and reduce litigation risk. As an HR manager, you will want to get process right and may be nervous of some of the pitfalls such as falling foul of a discrimination claim. At its simplest, making employees redundant involves meaningful consultation and trying to find them suitable alternative employment. We are experts at guiding you through the process.

    Employment Tribunal

Even the best managed businesses will be required to defend employment tribunal proceedings from time to time. Since the ACAS Early Conciliation Scheme started in 2014, your company will be approached by ACAS to see if your company wishes to settle the claim. We can represent you in that process and also at the Employment Tribunal, if you do not wish to, or are unable to settle.

    Settlement Agreement – Employer

In our experience, settlement agreements are used widely by employers. They allow an employer and employee to terminate employment in a civilised fashion with the employer knowing they cannot be sued and the employee receiving appropriate compensation.
